TERMS AND CONDITIONS :

You are advised to carefully read these additional terms and conditions before agreeing to subscribe to a Fikma Travel & Agency holiday package. These terms and conditions are in addition to the provisions of terms and conditions in the Fourth Schedule of the Tourism Industry Act 1992.

It does not reduce the validity of the provisions of the Fourth Schedule of the Tourism Industry Act 1992 and where there is any contradiction, the terms and conditions in the Fourth Schedule of the Tourism Industry Act 1992 shall apply. If you make a reservation and pay a deposit to subscribe to a Fikma Travel & Agency holiday package, you are bound by contract with Fikma Travel & Agency. It signifies that you have agreed to all the terms and conditions of Fikma Travel & Agency.

1. How to Make a Booking
– Payment is made in three (3) stages, namely the first deposit, the second deposit (2ndpayment) and the full payment (fullpayment).
– You need to contact us first before making a booking to find out the availability of seats and the trip dates that are still open.
– A deposit is required to make a booking without making a deposit payment and seats will not be held without any booking and sufficient payment.
– Your details must be sent to us immediately after the booking has been made.
– The deposit for packages above RM5000 and above is RM1000 and the second deposit of RM2000 must be made after two (2) months from the date of payment of the first deposit.
– For packages below RM5000, the deposit is RM500 and the second deposit of RM1000 after two (2) months from the date of payment of the first deposit.
– For packages that depend on the current flight ticket price, the deposit is dependent on the current flight ticket price.
– Full payment must be made forty-five (45) days before the trip departs. If you fail to pay the payment at the specified time without any notice, we reserve the right to cancel the trip & penalty charges will be applied.
– If the booking is made less than sixty (60) days before the trip. You must make full payment immediately.
– You must pay the booking deposit at the time and amount specified, if late the package price offered may change based on the current flight ticket price.
– Proof of payment receipt must be written with your name, identity card number, & trip date on it before submitting to us.
– Booking and deposit payment that has been made indicates agreement and is final proof that you have agreed to all the terms and conditions of our company.

2. Accuracy of Details or Personal Information During Package Booking
– When booking a package, all details you provide to Fikma Travel & Agency are information that will be used by the company to complete your package.
– You are required to review your own details / personal information before making a deposit payment and if no corrections are made, all information provided is considered true and final.
– Fikma Travel & Agency cannot be held responsible for any incidents or problems that arise as a result of errors in the details or personal information you provide.
You are fully responsible for declaring your health status before making payment.
– Fikma Travel & Agency reserves the right to refuse your booking if your health condition is found to endanger your own health and safety or reduce the comfort or enjoyment of other members of the tour group.
– If you require assistance due to your health condition, you are required to bring another family member to assist you throughout the trip and bring your own assistive devices such as wheelchairs and medications.
– Fikma Travel & Agency cannot be held responsible for taking care of you personally or providing medications if you are sick.
– If your condition requires personal care, Fikma Travel & Agency reserves the right to charge you an additional fee to hire a third party to take care of you.

3. Confirmation of Correct Information and Package Details
– You are required to check the information about the package booked before making a deposit payment including the package price, flight dates (outbound & return) and departure and arrival times, the package selected including the hotel accommodation and room type selected and other information as stated on the payment receipt and/or confirmation letter.
– You are deemed to have agreed to all information in the receipt or confirmation letter and are fully responsible for any additional risks or costs on your package if you fail to report any errors or omissions in your package details within 24 hours from the date the receipt or confirmation letter is issued.

4. Package Payment
– Fikma Travel & Agency only accepts payment in cash, bank draft or personal cheque and credit card via terminals at certain branches only.
– Fikma Travel & Agency reserves the right to withhold your package booking until the deposit payment is settled via your bank draft or personal cheque.
– Fikma Travel & Agency is not responsible if the package you have booked has been sold out due to a delay in settling your bank draft or personal cheque.
– For package payments less than 7 working days before the flight date,Fikma Travel & Agency reserves the right to reject payment by personal cheque and if no cash payment is made, your package may be automatically cancelled and any package payments that have been paid will be forfeited in accordance with the Fourth Schedule of the Tourism Industry Act 1992, but if you inform us in advance, we will consider the application.
– Payment receipts must be kept for reference purposes and proof of payment in relation to all transactions with Fikma Travel & Agency.

5. Package Payment
– Tipping is a payment for tour guides (TourGuide) and vehicle drivers (Drivers).
– Travel insurance is not included in the package Participants are encouraged to take out travel insurance with any insurance agent. We can also arrange travel insurance (Prices according to the type of package and destination taken).
– Entrance tickets to the visit sites are not included in the package, except those that have been (Entrance fees are the participant’s choice).
– Additional fees will be charged for trips during peak season (depending on current conditions).
– A charge for a single room (single room) will be charged for bookings throughout the trip.

6. Transportation
– Participants’ movement from one destination to another is by bus, minibus, van and others depending on the Fikma Travel & Agency package.
– Type of flight (airlines) depends on the current conditions that are appropriate for the price. Any changes we will inform later. (Mahan Air, Oman Air, Air Asia, Saudi Air, Qatar Airways, Turkish Airlines, Emirates Airlines, Thai Airways, KLM Airlines, Malaysia Airlines and others).
– The weight of the luggage that has been provided is between 20-30Kg according to the type of flight that has been The weight of hand-carry luggage is only 7Kg. If the weight of the participant’s luggage exceeds that specified by the company according to the package, the participant must pay the excess baggage weight to the airline. The tour company will not be responsible for excess baggage of participants. Your package includes flight tickets from KLIA/KLIA2 to the destination only but does not include domestic flight tickets to KLIA/KLIA2. Even though the confirmation letter with your flight schedule has been printed, the schedule is still subject to amendment by the airline.
– In the event of any change or amendment to the flight schedule, Fikma Travel & Agency cannot be held responsible for any compensation including domestic ticket change fees, additional hotels or other inconveniences resulting from the amendment.
– Fikma Travel & Agency is also not responsible for any compensation claims, arising from schedule changes, delays, cancellations, missed connections, mechanical problems, bad weather, seat rearrangement in the flight, loss / delay of luggage, delay in immigration inspection and / or denied boarding by the airline.

7. Package Cancellation & Change
– Any cancellation or change of package / date must be in writing or email only to our staff according to their respective packages to avoid misunderstandings. Please also include a death certificate, doctor’s letter or supporting documents. (If applicable).
– If the cancellation of the package is made due to personal actions and reasons, you are subject to all the terms and conditions that have been set.
– If Fikma Travel & Agency receives notice for cancellation of the booking/package change 45 days or more before the departure date, a minimum administration fee of RM50.00 or 2% of the tour package (whichever is higher) per person will be charged.

– If flight tickets have been purchased, or hotel reservations and others have been made, the cost of the price value must be borne by the participant 100%.
– Date changes, additional (fare & tax) and so on are the responsibility of the participant. If we ourselves cancel the trip for certain reasons (security / emergency after being confirmed by the embassy of the country visited) or the airline postpones the travel time, we will give you two (2) options (after discussing with the airline) namely either the date of the tour is postponed or the tour venue is changed. If the participant does not want to follow the option we provide, the booking fee cannot be refunded except for the payment subject to the terms and conditions then in effect (if any).
– If your own company/department cancels/does not approve the leave after the booking is made, Fikma Travel & Agency will not be responsible. You must refer to your company/department that made the decision.
– If you receive any immigration restrictions, Visa, additional expenses, refunds and compensation payments such as when arriving at the country of visit, you are fully responsible for such payments or losses.

8. Itinerary
– The attached itinerary is a general or standard schedule. If there are any changes in terms of time and so on, we will inform you later.
– We reserve the right to reschedule or change the tour location or skip the tour location depending on the current situation, whether in terms of weather, traffic congestion, unexpected things that occur and any celebrations during the tour. Delays by participants may also result in changes to the itinerary. You must comply with all regulations that have been set at the tour location.

9. Final Preparation
– Each participant who will join our trip must ensure that they do not have any blacklists related to/restrictions in terms of taxation, loans and the like, to ensure that all participants do not experience problems with immigration that may cause participants to miss their flights.
– Please ensure that your passport validity period (validity/expired date) is more than six (6) months from the date of travel.
– For holders other than Malaysian passports, you need to consult the Immigration Department or embassy in their respective countries to ensure whether a visa is required or not.
– We will not be responsible if any problems occur at the airport later as a result of the above.

10. Accommodation
– Minimum booking is two (2) adults (1 room). If someone makes a booking for one person (single) and within 45 days before the trip there is still no partner/roommate, we reserve the right to charge an additional charge of RM1500 per person for a single room (depending on the package taken).
– If the participant refuses to pay the additional charge, we reserve the right to cancel the participant’s booking without refund.
– Hotel rooms provided are only Twin and Double bed rooms. Extra bed for the third participant if the participant makes a Triple room booking.

11. Pandemic (Act of God)
– Every package trip that has been arranged by Fikma Travel & Agency will still continue if there are no restrictions from the country of visit due to epidemic/disease or the like to travel to their country, however, the Fikma Travel & Agency company reserves the right to continue the trip by changing the program tour schedule and practicing the appropriate preventive and hygiene measures to ensure the safety of the participants.
– All costs or payments made by Fikma Travel & Agency to airlines, hotels, transportation, food and local tourism companies will not be refunded to participants if the participant cancels the package due to an epidemic/disease as long as the country concerned does not block entry to their country and there is no ban from the Malaysian government.
– The company will follow all instructions of the terms and conditions of the airlines, hotels, transportation, food and local tourism companies and will inform participants.

12. Claims
– The matter of claiming VAT/tax for personal expenses on any Fikma Travel & Agency package is our business. All matters and losses for such matters, we will not be responsible for.Any claim for damage/loss/theft of personal belongings must be accompanied by a report from the police or airport.
– Taking out insurance is highly encouraged, whether with our insurance representative or with another insurance agent. Meanwhile, if an insurance claim occurs, please contact the insurance agent directly.
– Fikma Travel & Agency will only be responsible for the products or services that have been agreed upon. Claims can only be made for the services offered.
– Any refund claim is subject to the terms and conditions of the airline agency without any guarantee of refund obtained or conditional.
– Claims for refund of booking payment cannot be made against Fikma Travel & Agency or sued for any unexpected events such as natural disasters and outbreaks of disease (Act 0f GOD), emergencies, wars and the like.
– All claims that are not included in the Fikma Travel & Agency service offer, must wait and follow the decision from the agency, department and government of the country involved.Customers cannot sue or take the case to court if there is a disagreement before discussing it properly with Fikma Travel & Agency.

13. Health and Insurance Coverage
– You MUST take out adequate and suitable travel insurance to undertake a tour organised by Fikma Travel & Agency and this is a condition of your contract with Fikma Travel & Agency.
– Customers are solely responsible for arranging their own insurance or taking it out with our insurance agent and we reserve the right to request a copy of the insurance policy and/or receipt.A suitable insurance policy should provide adequate cover for medical expenses arising through illness or accident before or during the holiday and loss of holiday money through cancellation and curtailment of holiday for insurable reasons.
– You must be satisfied that your insurance fully covers all your personal needs including pre-existing medical conditions and you should ensure that there are no exclusion clauses which limit cover for the type of activities undertaken during the tour.
– Your insurance policy should also cover loss of baggage, delays, unforeseen changes to travel arrangements, cancellations, natural disasters, unforeseen circumstances, acts of God, emergency medical evacuation, communicable diseases.
– We reserve the right to cancel the booking, without any liability for refund, of any customer who fails to satisfy us that they have purchased appropriate travel insurance in accordance with Clauses. Furthermore, if you choose to travel without adequate insurance cover, we will not be liable for any losses incurred, for which insurance cover will be available.
– Customers must be prepared to travel and in good health to participate in the tour.
– Customers must undergo a medical examination before attempting to participate in any Fikma Travel & Agency organized package. It is important that customers with health problems or pre-existing medical conditions, must inform us in advance before making a booking.
– Customers are also advised to consult a doctor/specialist for vaccinations or other medical needs before traveling and carry a medical report with them throughout the trip.
– Participants with health problems such as heart/asthma/chronic/pregnancy etc. are requested to obtain a letter of confirmation from a doctor to confirm that the participant is allowed to participate in the Fikma Travel & Agency package or board the plane and carry appropriate and sufficient medications.
– Participants with disabilities or those who use wheelchairs/canes are not encouraged to follow any Fikma Travel & Agency package unless they have an escort or relative with them throughout the trip to facilitate the arrangements there later.
– In the event of an unwanted event such as an accident or death,
– Fikma Travel & Agency will only help manage related matters according to standard health and safety procedures without bearing any costs involved.
– Fikma Travel & Agency has the right to cancel a participant’s booking without any refund if there is a participant who is not satisfied with the travel insurance provided by Fikma Travel & Agency depending on the clauses that have been set.
– If you travel with Fikma Travel & Agency without any travel insurance, the company will not be responsible for any inconvenience or hardship that may occur later.
